Terms & Conditions

Agreement
By commissioning and using the Galaxy Broadband service provided by Hughes, you agree to be bound by and use the service in compliance with these Terms and Conditions. This agreement effective as of the date equipment is delivered to customer. It is also agreed that you will abide by the Hughes Internet Use Policy and Fair Access Policy.

Monthly Fee
Purchase your hardware and installation upfront and pay for service starting at just $89.99 per month. See "Features and Restriction Details" below for more information.

Hardware Fee Details
DIRECWAY hardware is available from Galaxy Broadband Authorized Resellers coast-to-coast. Price may vary depending on location.

Installation Charges
Depending upon site requirements, installation costs may vary. See What's Included With Installation for what's included in a standard install, and which services are considered extra. Allow $300 - $500 for standard installation plus additional charges. Any additional installation costs will be paid directly to your installer. Please clearly discuss site requirements with your installer before system is installed.

Activation Fee
$49.95 one-time fee.

Term Commitment
12 months minimum initial term. Automatically renewed monthly after initial 12-month term.

Early Termination Fee
If cancelled before the required initial 12-months is completed, the balance of the contract (monthly fee x number of months remaining) or a $450 cancellation fee will be required, whichever is greater. For service cancellation subsequent to the initial 12-month commitment, Galaxy Broadband must receive notice of cancellation in writing 60 days prior to deactivation. A $49.95 processing fee will apply. Should these Terms & Conditions not be followed, Galaxy Broadband has the right to terminate service without notice or liability whatsoever.

Seasonal Suspension
Customers are allowed to suspend service once annually due to vacation or extended leave. Additional suspension requests will be subject to a $49.95 processing fee.

Changes
Any changes to service are subject to $49.95 processing fee.

Billing Options
Credit card billing and pre-authorized payments.

Payment
Monthly fees are payable when due. Accurate and complete billing information must be provided. Past due accounts are subject to a late payment fee. Delinquent accounts may be suspended or cancelled at the sole discretion of Galaxy Broadband; however, monthly service charges will apply until account cancellation is received in writing at Galaxy Broadband. Suspended accounts are subject to a $49.95 processing fee. Payment returned from a financial institution for insufficient funds are subject to $30.00 service charge. All outstanding balances must be paid on used equipment before system can be re-activated.

Installation
Industry Canada has very strict regulations for installing and pointing a transmitter, therefore only certified Direcway installers are authorized to install equipment. All costs related to inside and outside wiring and mounting of the system are the responsibility of the Customer. Galaxy Broadband, its agents, employees, representatives, or contractors assume no liability for damages or loss or destruction of Customer's hardware, software, files, or data. It is the Customer's responsibility to backup all existing files and email prior to installation or service level changes.

Service
Upload and download speeds cannot be guaranteed, but will vary depending upon location, weather, wiring, Internet traffic, website content, as well as overall performance and configuration of your computer.

Feature and Restriction Details
DIRECWAY service and its usage is subject to the Fair Access Policy. Actual speeds vary based on the amount of traffic on the Internet, content on a particular Web site or by the overall performance and configuration of your computer. Stated speeds are not guaranteed. Professional Installation is required. Monthly service fees apply; one-year commitment required.

Cost of Access for Additional Computer
No additional cost. User must provide networking equipment. Galaxy Broadband does not support network troubleshooting.

Computer Requirements

Customer certifies that the computer being used meets the minimum use requirements (see PC Requirements below). If not, it is the Customer's responsibility to upgrade said computer to meet minimum use requirements. Otherwise, Galaxy Broadband assumes no system support liability whatsoever.

DW6000 is also compatible with MAC: 9.0-10.2 (excludes 10.0).

Important Note: Galaxy Broadband does not support non-Windows-based operating systems or versions of Windows before Windows 98 Second Edition.

Warranty 12 months for Hughes equipment. Normal replacement timeframe is seven days from the time it is resolved defective. This warranty does not cover labour, installation or freight charges that may apply to replace defective unit.
